TERMS AND CONDITIONS TO BE READ AND UNDERSTOOD  BEFORE YOU BOOK YOUR TRAVEL

Your Fairytale Vacation’s job is to arrange travel at your request. As a result, we will work with  third-party vendors (also referred to herein as “Suppliers”), including but not limited to airlines,  tickets, cruising companies, suppliers, transfer companies, car rental companies, and tour operators  who are responsible for providing your travel service or product. Before we make the  arrangements for your flight, hotel, car rental, tour, cruise, or other arrangements, we require that  you sign and initial this form. Your signature will signify your agreement with the following terms  and conditions:

1. How long is a quote valid?

Your Fairytale Vacation cannot guarantee a quote for any length of time. Packages, trips,  ticket prices, and amenities are subject to change at any time due to availability, including  both selling out and price increases. The booking typically can only be held for a set period  of time, so ask your travel agent for details.

2. What payment options do I have?

We require a credit or debit card for payment. We will send you a separate credit card  authorization allowing us to charge your card to the third-party Suppliers listed in your  quote. This document, along with the payment, is required prior to booking any trip.

3. Can I change my booking if I want to?

This depends on a variety of factors, including the rules of the tickets you purchase and  the rules of the third-party supplier. If you have a need to make some changes, talk to  your travel agent and they will work with you to attempt to accommodate your needs.

4. What happens if I need to cancel my booking or if I have other issues related to my trip?

a. Cancellation fees will be payable, depending on when and why you cancel. Ask  your travel agent what refund options are available and under what circumstances.  Your Fairytale Vacation assumes no responsibility for and shall not be liable for any  refund, personal injury, illness, property damage, or other loss, accident, delay,  inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or  negligent acts, or omissions of any third party; (2) any defect in or failure of any  vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by any third party; or

(3) any wrongful or negligent acts or omissions on the part of any other party not  under Your Fairytale Vacation’s control. You hereby release Your Fairytale Vacation  from all claims arising out of any problem covered in this paragraph.

b. You acknowledge and understand that cruise lines, tour operators, and other  Suppliers have their own contracts covering cancellation penalties and other terms and  conditions, and that you will be bound by their terms and conditions.

c. If the trip is prevented, hindered, delayed or otherwise made impracticable by  reason of strike, flood, riot, fire, explosion, war, pandemic, or any other casualty or cause beyond the control of any party (hereafter called “event”), and which cannot be  overcome by reasonable diligence and without unusual expense, Your Fairytale will  work diligently to (a)reschedule the trip as soon as is practicable, and/or (b) work with the Suppliers to obtain a refund if it is possible. Your Fairytale Vacation is released  and held harmless for any “event” as described in this paragraph, including obtaining a  refund that is refused or denied by a third-party.

d. Travelers assume all risks related to exposure to illness while traveling, including  COVID-19.

5. What should I know before my trip departure?

Your Fairytale Vacation has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes  at locations to which you may travel. For information concerning possible dangers at  destinations, Your Fairytale Vacation recommends checking the Travel Warnings  Section of the U.S. State Department website www.travel.state.gov. For medical

information, Your Fairytale Vacation recommends contacting the Centers for Disease  Control website www.cdc.gov/travel. You assume full and complete responsibility for  checking and verifying any and all passport, visa, vaccination, or other entry  requirements of your destination(s), and all conditions regarding health, safety,  security, political stability, and labor or civil unrest at such destination(s). You hereby  release Your Fairytale Vacation from all claims arising out of any problem covered in  this paragraph.

6. Should I purchase Travel Insurance?

For your protection, we strongly recommend that you purchase Travel Insurance that  covers trip cancellation, interruption, medical treatment, etc., and that you check the  appropriate box below. We also strongly recommend that you use a credit card for  your purchase, so that you can exercise your rights under the Fair Credit Billing Act if  you do not receive the services you purchased. Your signature below indicates that  you grant permission to Your Fairytale Vacation and/or the appropriate Supplier to charge your credit card.

7. What happens if I have a dispute with Your Fairytale Vacation?

First, reach out to us. Our goal is for you to have a great trip. While we cannot make  any guarantees, we are definitely here for you. To the extent that we cannot reach an  amicable solution, you agree that the courts in Fort Bend County, TX, will be the  exclusive jurisdiction for all claims brought by you or Your Fairytale Vacation, and  you hereby submit to the personal jurisdiction of those courts.
